President Maithripala Sirisena reportedly told the TNA parliamentary group yesterday that he would not reappoint UNP leader Ranil

Wickremesinghe as the Prime Minister even if his party secured a majority in Parliament.

He met with the TNA delegation on Wednesday and discussed the current political situation. He reportedly asked the TNA to abstain from the vote of no confidence if it were moved.

However, the TNA said it had taken a decision to vote against the appointment of former President Mahinda Rajapaksa as the Prime Minister. In response, the President is reported to have said that he will not reappoint Mr. Wickremesinghe as the Prime Minister.

Meanwhile, the President assured the parliamentary of his UPFA on Wednesday evening that he would, for sure, secure the required majority to form a stable administration, and therefore no one in the party should worry about it.

Why there is a need of re-appointing when Speaker recognized RW as the priminister up to date.

The constitution allows president to appoint a person as pri-minister only when the proposed person commands majority means there should be majority vote count and given the position afterwards.

Whats happening now is other way around. My3 and MR are having honeymoon before marriage and children too. We have become joke of the international community. Thanks to one Idiot.

No point of showing the majority. President has the executive powers. If president doesn't share the power with UNP , nothing will be happen after 14th
Your position is correct. Subsequently in case the vote on account is defeated it will lead to dissolution of parliament by the President and in my opinion it will be good b'cos UNPs popularity can be exposed at a General Election. MR+MS can form a strong stable govt with absolute majority.

Sri Lanka in civilizational crisis amid constitutional violations

Sri Lanka's constitution has been violated plunging the country into a political crisis two weeks ago and more violations are on the way, a top political scientist and constitutional expert has warned.


"I believe the country is not just in a political crisis, but is fast moving towards a crisis in civilization," Emeritus Professor at Colombo University Jayadeva Uyangoda said.

"What did citizens see on October 26? A portion of the political class who have pledged to uphold the country's highest law, the constitution, breaking it without thought," 

President Maithripala Sirisena ousted his coalition ally Ranil Wickremesinghe from the Prime Minister post, and planted ex-President Mahinda Rajapaksa as the Premier, in a controversial move which as been described as a coup by critics.

Speaking at the Ven. Maduluwawe Sobitha Thero Memorial Lecture, Uyangoda said that the ministers taking up new offices now should amend their oaths.

"They should say something new like, 'I take oaths to break the constitution and use political power illegally and immorally for personal benefit'," Uyangoda said.

"The political darkness is rapidly approaching us again," he said.

He said a politician who came into power with popular vote to reform the system is now authoring the new darkness.

"The political class now considers political corruption as a key and legitimate part of establishing and ousting governments."

A number of legislators crossed over to take positions in Rajapaksa's new cabinet.

Allegations have been levelled that this is being done for huge sums of money.

"Political corruption is now being linked to democracy," Uyangoda said.

"Politicans are attempting to create a new philosophy that although corruption can survive without democracy, democracy cannot surive without political corruption," he said.

He said that so-called law experts are attempting to deceive the public by saying the recent unconstitutional act is constitutional.

"We're now in a post-democratic era where the consittuion has been violated," Uyangoda said.

"We haven't understood the implications yet."

"When there is public fallout with political violence, extreme violations of human rights and bloodbaths, we will get a new understanding of political uncertainty," he said.

Uyangoda was also critical of the coalition government which was in power from 2015 to October 26, 2018.

He said the duty of the coalition government was to rebuild public trust in government, after it had broken earlier.

"From mid-2015 to October 26, the government had given little effort to rebuilding public trust."

"Even the coalition government leaders engaged in economic corruption, making it a part of politics," he said.

The country is not faced with a constitutional crisis at all as reported by some quarters. The million dollar question is if so, why didn't the UNP move Supreme Court soon after the dismissal of RW???
However, it is reported finally they have decided to go for SC's interpretation on Monday (12th). So, let's wait till then.
As to the foreign outflow, this is not the first time they have done so. When economic & political stability returns they come back. The CSE remained sluggish for the past nearly 4 years while not a butterfly was concerned about it, now what?????
Supreme Court's ruling will be final & binding & it will not take long b'cos the interpretation is straight forward and heavily weighs in favor of the President.
All what i know is that 'DIASPORA' is in crisis!

I am not talking about making Law at Supreme Court, Talking about Parliament supremacy over Supreme Court and precedent case also there, where SLFP Government’s speaker declared parliament supremacy over Supreme Court. They can only get the interpretation/ clarification form Supreme Court because most of the parliamentarians are below the level of education.
If the president wants to sack the government, he has to ask the simple 113 member majority of prime Minister’s Government at Parliament / No confidence motion or he has to penalize / impeach the prime minister’s government at Supreme Court as a traitor or other means.

Constitution is the supreme law of the land and if President had exercised powers vested in him in accordance with the constitution and if it concurs with the SC's interpretation the matter ends.

The issue in the case cited as precedence:

“The Hon Speaker informed the Committee that, in terms of the provisions of the Article 121(1) of the Constitution, when a petition is filed against a Bill in the Supreme Court, a copy thereof shall at the same time be delivered to the Speaker. 

However, such
petition filed against the Bill entitled ‘Divineguma’, was not delivered to the Speaker in the manner prescribed in the said Constitutional provisions. The Hon Speaker invited the members of the Committee to share their views in this regard. 

After long deliberations, the Committee was of the view that Parliamentary supremacy and the authority of the Speaker as envisaged in the Constitution should be recognized and given effect to by all other arms of authority

Supporters of Sri Lanka's fired prime minister and a top election official on Monday challenged in court the president's sacking of parliament, upping the ante in a political crisis that has sparked international alarm.

The United States has led a chorus of international concern over events in the strategically important Indian Ocean island nation of 21 million people.

Three political parties holding an absolute majority in parliament and Ratnajeevan Hoole, an election commissioner and one of three officials tasked with conducting polls, on Monday asked the Supreme Court to declare the president's actions illegal.

The court, which heard preliminary submissions, has adjourned until Tuesday.

In the five-page petition, Hoole said Sirisena broke the law in calling the snap elections for January 5 after a string of unconstitutional moves since October 26 when he fired Ranil Wickremesinghe, the prime minister.

Wickremesinghe's United National Party (UNP), the main opposition Tamil National Alliance (TNA) and the leftist JVP, or People's Liberation Front challenged Sirisena's action in the court.

TNA spokesman M. A. Sumanthiran said the Supreme Court agreed to take up the petitions immediately considering the importance of the issue.

"We are also asking for an interim order" for an injunction against preparations for the election, which would be two years ahead of schedule, Sumanthiran said.

Several petitioners also asked that parliament be restored until the court has ruled on their plea.

Court officials said Chief Justice Nalin Perera and two other judges decided to fast-track the hearings.

Sarath Amunugama, appointed foreign minister by Sirisena, told Colombo-based diplomats Monday that he expected a verdict within five days.

Legal experts say the dissolved parliament would have to be restored if the Supreme Court holds with the petitioners. If not, the January 5 election will have to go ahead.

Independent election monitors have also questioned the legality of the snap poll announced by Sirisena.

- Civil unrest fears -

Wickremesinghe remains holed up in the prime minister's official residence, and both he and Rajapakse are attempting to run parallel administrations.

On Sunday night, speaker Karu Jayasuriya urged civil servants to defy Sirisena's "illegal orders".

But later Sirisena defended his actions, saying violence among rival MPs could have led to "civil unrest" across Sri Lanka if the legislature had met as scheduled this week.

"Had I allowed the parliament to meet on November 14, there would have been violence in the House and it could have spread to our villages and towns," Sirisena said in a televised address.
"I acted to prevent civil unrest."
Wickremesinghe rejected this outright, saying Sirisena had "brushed aside the constitution" in sacking the legislature.

"He has pushed the country into an unprecedented mess, destroyed its image and damaged international confidence in the country," he said in a statement.
Sirisena's rivals maintain that he had no constitutional power to sack the assembly before it completed four-and-a-half years of its five-year term that ends in August 2020.

Only China has recognised the appointment of Rajapakse, who during his decade as president until 2015 relied heavily on Beijing for diplomatic and financial support as the West shunned him.
While in power Rajapakse ended Sri Lanka's four-decade civil war by crushing the separatist Tamil Tigers. But 40,000 ethnic Tamils were allegedly massacred in the process. 

Seventeen journalists and media workers were killed during his time in power, and Rajapakse and his family have been accused of using his period in office to line their pockets through corruption.
Monday's meeting of diplomats called by Amunugama was boycotted by several Western diplomats while others sent low-level representatives, diplomatic sources said.

One wonders why EC member Hoole did not file any petition against the postponement of PC elections by RW's govt denying people of their basic human & democratic right to vote and now when an election is to be held he is opposing it. The Attorney General Department always represents the government side, all 17 petitions filed against including The Attorney General Department.
 President dissolved the parliament after getting the advice from The Attorney General Department (as an usual practice) 
Judgment will say the validity of the dissolution of parliament.

(LBO) – Sri Lanka’s Supreme Court has issued an interim order staying operation of the Gazette proclamation dissolving the Parliament till 7 December 2018.

Leave to proceed has been granted for all the Fundamental Rights petitions heard and the case has been fixed for argument on the first week of December 2018.

The plan was clear, Ranil was the prime minister, he planned to kill Sirisena and become president, under the 19th amendment everybody thought presidential powers reduced, but what actually happened is increase of executive powers, here even the supreme court didnt see this because this clause was not presented to court before passing in parliament, now the ambuiguity is so much that even supreme court can not give verdict, if a verdict given , this will set precedence and all the other verdicts will follow this, in that case a president can dissolve parliament twice a month, the 19th amendemnt brought by jadapalana put entire country in anarchy, here ultimate aim was ranil to remain in power being immortal

Supporters of the United National Party (UNP) gathered outside the court complex in Colombo on Tuesday (13) evening cheer the Supreme Court’s decision on the petitions filed challenging the dissolution of the Parliament.
The court issued an interim order suspending the Gazette notification issued by the President to dissolve Parliament and calling for fresh polls, until December 07.
Politicians of the UNP and members of the alliance (UNF) spoke to media following the court’s decision.

Don't jump the gun. Final decision is fixed for next month, probably before a full bench of the
SC. Was their a floor test when RW was appointed as PM by MS with only around 40 UNP MPs in parliament? 
So, MR will continue as PM, and in my opinion MS only tried his best to avoid chaos in & outside the Parliament. Finally the decision to dissolve may go for a referendum.
Don't you think an "All island peoples test" is better than a "floor test" at a time of constitutional crisis. In Sri Lanka Sovereignty is in the people and it is inalienable and at a time of constitutional crisis the people should be allowed to have their say, failing which one cannot rule out an unprecedented chaos & turmoil in the country especially at a time when the UNP govt is extremely unpopular.
